These Terms form an agreement between you and the operators of Clarity. Read them before accessing or using the website, software, keys, dashboards, APIs, or related services.
1. Acceptance of these Terms
By visiting the Clarity website, requesting or using a key, using Clarity software, connecting to an API, accessing an administrative area, or otherwise interacting with a Clarity service, you confirm that you have read, understood, and agreed to these Terms and the Privacy Policy. If you do not agree, do not access or use the service.
These Terms apply to all versions, features, domains, integrations, interfaces, and related systems operated under the Clarity name. Additional notices shown within a product or feature form part of these Terms where they concern that product or feature.
2. Operator and ownership structure
Clarity is operated by its owners and authorized administrators. References to “Clarity,” “we,” “us,” and “our” mean the person or entity responsible for operating the service at the relevant time. Ownership, administrative roles, and the operating structure may change.
Unless and until a formal operating entity is publicly identified, these Terms do not represent that Clarity is incorporated in a particular state or that any individual owner personally guarantees the service. When a legal operating entity is established or designated, Clarity may update these Terms to identify its exact legal name, registered address, and governing state.
3. Eligibility and authority
You may use Clarity only if you are legally capable of entering into these Terms in your location. If you are below the age of legal majority, you may use the service only with permission and supervision from a parent or legal guardian where required by law.
If you use Clarity on behalf of an organization or another person, you confirm that you have authority to accept these Terms for them. You may not use the service where doing so is prohibited by law, sanctions, court order, or another binding obligation.
4. Description of the service
Clarity may provide a website, software, compatibility information, access workflows, update notes, community links, APIs, dashboards, and related technical services. Features may vary by platform, device, region, or user.
Clarity is not affiliated with, endorsed by, or operated by third-party platforms, software developers, advertising providers, or other third parties unless expressly stated. References to third-party products are descriptive and do not imply ownership, sponsorship, or partnership.
5. Limited and revocable license
Subject to these Terms, Clarity grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable permission to access and use the service for its intended purpose. This permission does not transfer ownership of Clarity code, branding, interfaces, documentation, designs, databases, or other materials.
You may not sell, lease, sublicense, mirror, repackage, impersonate, or commercially redistribute Clarity or protected portions of it without written authorization. You may not remove attribution, bypass access controls, falsely claim authorship, or present a modified copy as an official Clarity release.
6. Access, keys, sessions, and authentication
Some features may require a key, session token, password, PIN, API credential, device authorization, or another access method. You are responsible for keeping those credentials confidential and for activity performed through them. Do not share administrative credentials, private API keys, webhook secrets, or access tokens.
Clarity may apply expiration periods, device limits, session limits, rate limits, verification checks, or other controls. A key or session does not create permanent access. We may revoke, rotate, suspend, or refuse credentials where reasonably necessary to protect the service, investigate abuse, comply with law, or maintain security.
7. Technical data and security telemetry
To operate and protect the service, Clarity may process technical information such as IP addresses, request headers, timestamps, session identifiers, browser and operating-system details, approximate location derived from an IP address, error reports, execution-environment information, and usage or security events.
When Clarity software is executed, it may also collect or generate hardware identifiers, device identifiers, installation identifiers, environment identifiers, authorization data, compatibility information, and anti-abuse telemetry where available. These identifiers may be hashed, transformed, or linked to a key or session.
This information may be used for authentication, access validation, fraud detection, rate limiting, abuse prevention, preventing unauthorized redistribution, limiting excessive sharing, debugging, compatibility checks, security investigations, and protecting Clarity infrastructure. Collection and use are described further in the Privacy Policy.
8. Acceptable use and prohibited conduct
You must not use Clarity to attack, disrupt, overload, probe, or gain unauthorized access to any Clarity server, account, database, API, dashboard, network, or connected service. You must not evade rate limits, forge authentication data, manipulate requests, interfere with logging, submit malicious payloads, or attempt to obtain private secrets or information.
You must not steal or resell keys, distribute modified malicious copies, impersonate staff, create fraudulent support messages, or use Clarity branding to deceive others. You must not knowingly introduce malware, credential theft, spyware, ransomware, destructive code, or other harmful functionality.
You are responsible for how you use the service and for complying with the rules and laws that apply to you. Clarity does not authorize harassment, fraud, theft, unauthorized access, or harm to other users or systems.
9. Third-party services
Clarity may interact with or link to hosting providers, databases, analytics services, access providers, advertising services, video platforms, community platforms, or other external services. Those services are controlled by their respective operators and governed by their own terms and privacy policies.
Information about third-party compatibility may become outdated. A listed status is informational and is not a guarantee that a third-party product is safe, available, authorized, or compatible. Clarity is not responsible for third-party outages, account action, data handling, malware, purchases, advertisements, or service changes.
10. Intellectual property
Clarity and its original source code, branding, logos, designs, text, interfaces, databases, documentation, graphics, and other original materials are protected by applicable intellectual-property laws. Third-party names, trademarks, artwork, and assets remain the property of their respective owners.
Feedback, bug reports, and suggestions may be used to improve Clarity without payment or obligation, provided that we do not claim ownership of material you did not have the right to submit.
11. Availability, updates, and changes
The service is provided on an “as available” basis. We may add, modify, suspend, restrict, replace, or remove any feature at any time. Platforms, APIs, domains, access systems, and compatibility status may change without notice.
Maintenance, security incidents, third-party changes, infrastructure failures, legal concerns, or platform updates may interrupt access. We do not guarantee continuous availability, a particular feature set, data preservation, or compatibility with any device or third-party tool.
12. Monitoring, enforcement, suspension, and termination
Clarity may review security logs, access records, telemetry, and reports to investigate suspected misuse. We may restrict or terminate access, invalidate keys, block IP addresses or device identifiers, limit requests, preserve relevant records, or take other proportionate action where we reasonably believe these Terms, security rules, or applicable law have been violated.
We may cooperate with hosting providers, security professionals, legal advisers, or lawful authorities where necessary. We are not required to disclose internal detection methods, evidence thresholds, anti-abuse rules, or security controls.
13. Disclaimers
To the maximum extent permitted by law, Clarity is provided without warranties of any kind, whether express, implied, or statutory. We do not warrant that the service will be uninterrupted, error-free, secure, compatible, accurate, or suitable for a particular purpose.
You understand that using software and third-party tools may carry risks, including instability, account restrictions, data loss, device issues, or third-party enforcement. You assume responsibility for deciding whether and how to use the service.
14. Limitation of liability
To the maximum extent permitted by applicable law, Clarity, its owners, administrators, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, access, reputation, accounts, devices, or business opportunities arising from or related to the service.
Where liability cannot legally be excluded, it will be limited to the greater of the amount you directly paid to Clarity for the relevant service during the three months before the event giving rise to the claim or ten United States dollars. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
15. Governing law and disputes
To the extent permitted by applicable law, these Terms are governed by applicable federal laws of the United States and, where state law is relevant, by the laws of the state in which Clarity’s operating person or entity is organized or principally established at the time a dispute arises, without regard to conflict-of-law rules.
Once Clarity publicly designates a formal operating entity and state, the designated state’s laws and courts may be identified in an updated version of these Terms. Until then, nothing in this section removes mandatory consumer protections or rights that cannot lawfully be waived in your country or region.
Before filing a formal claim, you agree to make a reasonable attempt to contact Clarity through its official support channels and describe the issue so the parties can try to resolve it informally.
16. Changes to these Terms
We may update these Terms when the service, ownership structure, legal requirements, data practices, or security systems change. The “Last Updated” date identifies the current version. Material changes may also be announced through the website or official community channels.
Your continued use after revised Terms take effect constitutes acceptance where permitted by law. If you do not agree to a revision, stop using the service.
